Pink Gellac is the data controller for the processing of personal data via the webshop. We attach great importance to the careful handling of personal data. Personal data is therefore carefully processed and secured by us. When processing personal data, we comply with the requirements of privacy legislation. This means, among other things, that:

• we clearly state the purposes for which we process personal data. We do so through this privacy statement;
• we limit our collection of personal data to only those personal data necessary for legitimate purposes;

When using our webshop, we obtain certain data from you. This may include personal data. We store and use personal data that is provided directly by you, in the context of the service you have requested, or where it is clear upon submission that it is being provided to us for processing.

We usually process your personal data to enter into or execute an agreement with you, for example when you purchase a product from us. Sometimes we process personal data to comply with a legal obligation, such as maintaining our financial records. For certain processing activities, such as sending our newsletter or displaying personalized advertisements through third parties, we ask for your consent. You can withdraw this consent at any time by contacting us by email (see our contact details below) or via the cookie banner. Finally, we may process your personal data on the basis of a legitimate interest. We only process personal data that we collect directly from you. We do not obtain personal data from third parties.

When you place an order with us, we use your personal data for payment, processing, and any return of that order. We only do this to the extent necessary to fulfill the agreement with you. You can create a personal account on our website. We use your name, e-mail address and a password chosen by you for this. This account makes shopping easier and faster and allows you to keep a wish list. It also allows you to retrieve your orders.

When you create a personal account, you are automatically enrolled in the Pink Premium Program. This is Pink Gellac's loyalty program with which you can earn discounts on your order or save up for gifts. You can earn Pink Points in various ways, for example by purchasing something from us online or in store, by referring a new customer via your personal link ('refer a friend'), or by following our social media accounts. We record your point balance and the action by which you earned points. We do this on the basis of Pink Gellac's legitimate interest, namely being able to offer our loyalty program and interact with our customers. If you do not wish to participate, you can always easily unsubscribe by contacting our customer service.

We offer various ways to contact us. This can be done via a contact form, chat function, email, WhatsApp, or by phone. You will be asked to fill in various details to handle your question. You choose which data you provide. The personal data you provide will then be processed for the handling of your question and/or complaint. We offer a newsletter with which we wish to inform interested parties about our products and/or services. After you have given your consent, your email address will be automatically added to the list of subscribers. Every newsletter contains a link with which you can unsubscribe.

When using our webshop, data may be published so that it is visible on the internet to everyone. You choose what information you publish when asking a question or posting a comment on a blog post. It is possible that you may be identifiable as a result, for example if you choose to leave your first and last name. Upon request, we will anonymize information that has been published. You always have the option to remain completely anonymous. The publication of your data takes place on the basis of our legitimate interest and yours, to give you the opportunity to respond to blog posts.

For quality purposes, we may use your personal data, for example if you submit a complaint about a product or our service. In addition, we process personal data to generate statistics. We do this on the basis of a legitimate interest, namely to continue improving our products and services.

When you purchase a product from us, we may subsequently approach you for a similar product via email, telephone including SMS, or other electronic means. If you do not wish to receive communications from us, you can unsubscribe. This can easily be done by clicking the 'unsubscribe button' at the bottom of an email or by following the instructions in our SMS messages (for example by replying STOP, via the unsubscribe link, or by contacting us via the contact details listed below). In addition, we process your personal data through cookies, to show you personalized advertisements, for example. More information about this can be found in paragraph 4 below.

We may disclose your personal data to third parties in the following cases for the reasons listed below: 

• to suppliers, to the extent necessary for the conclusion and performance of an agreement with you;
• if the services of third parties are used within the scope of agreements made with you (e.g. delivery services), Pink Gellac is entitled to disclose your personal data to the aforementioned third party to the extent necessary for the performance of the agreement to which you are, or the company you represent is, a party;
• if we suspect a violation of the rights of third parties, criminal offences or misuse, we may disclose personal data to third parties who have a legitimate interest in this respect or to bodies that serve the public interest. This may include enforcement authorities, such as the Public Prosecution Service or supervisory authorities;
• if we are required or entitled by law to provide personal data to third parties;
• we will provide details including your e-mail address and cookieID to our partners in order to show personalised advertisements;
• Pink Gellac also uses services provided by third-parties that act as "processors" (for example, hosting service providers and online marketing service providers). Pink Gellac is obliged to conclude a processing agreement with these service providers, which stipulates that they will only process personal data in accordance with Pink Gellac's instructions and subject to Pink Gellac's control. In this context, the necessary technical and organisational measures have been implemented to ensure that your data is processed reliably and securely.

In principle, your personal data will not be transmitted outside the European Economic Area. If, however, this does happen occasionally, Pink Gellac will take measures to ensure that the international transmission of personal data complies with applicable law.

Cookies are used on our webshop. When you first visit our webshop, a notification is displayed in which we explain why we use cookies. We use cookies that we place ourselves as well as cookies placed or read by third parties. Our website uses strictly necessary cookies that ensure, among other things, that the website functions properly. These are always active.

You can withdraw your consent at any time. You can do this in article 13 "Details of the cookie policy" of the privacy policy and adjust your settings there. If you give consent for targeted cookies, we and third parties will process your personal data to map your interests and show you personalized advertisements. We collect various personal data through cookies for this purpose, namely when you purchase something from us, create an account, subscribe to the newsletter, and/or visit our webshop. Based on this personal data, we determine your interests. We may then pass on the relevant advertisement, your email address, and cookie ID to partners, Google, and Meta, to show you targeted advertisements via these partners' media channels that match your interests.

We use Google Analytics to track how visitors use our webshop. We have entered into a data processing agreement with Google to make arrangements about the handling of our data. We have also allowed Google to use the obtained Analytics information for other Google services. We ask your consent for this.

The personal data described above is retained for as long as necessary to process your orders, including warranty. The personal data will then be deleted, unless there is a legal obligation requiring longer retention. Think, for example, of the fiscal retention obligation of seven years. If you have subscribed to the newsletter, we retain that consent until you unsubscribe.
