Pink Gellac is the data controller for the processing of personal data collected through the web shop. We are committed to the careful handling of personal data. We use the utmost care when processing and securing personal data.
In our processing, we comply with the requirements laid down in privacy legislation. This means, among other things, that:
- we clearly state the purposes for which we process personal data. We do so through this privacy statement;
- we limit our collection of personal data to only those personal data necessary for legitimate purposes;
- we first ask you for your express consent to process your personal data in cases where your consent is required;
- we take appropriate security measures to protect your personal data and require the same from parties who process personal data on our instructions; and
- we respect your right, for example, to inspect, rectify or delete your personal data.

2. Using our web shop
When using our web shop, we collect personal data from you. This may include personal data. We store and use personal data provided directly by you in the context of the service you have requested, or for which it is clear at the time of submission that it is provided to us for processing.
We usually process your personal data to conclude or perform an agreement with you, for example when you buy a product from us. Sometimes we process personal data to comply with a legal obligation, such as the keeping of our financial records.
For some forms of processing, such as the sending of our newsletter, or showing you personalised advertisements via third parties, we ask you for your consent. You can always withdraw this consent by contacting us (see our contact details below) or via the cookie banner.
Finally, we can process your personal data on the basis of a legitimate interest. We only process personal data that we collect directly from you. We do not get personal data from third parties.
2.1 Payment, handling and order return
When you place an order with us, we use your personal data for payment, processing and any return of an order. We only do this to the extent necessary to perform the agreement with you. If necessary in this context, we may also provide your personal data to third parties. More information on this can be found further down in this privacy statement.
2.2 Personal account
You can create a personal account on our website. We use your name, e-mail address and a password chosen by you for this. This account makes shopping easier and faster and allows you to keep a wish list. It also allows you to retrieve your orders.
2.3 Pink Premium Program
When you create a personal account, you automatically become a member of the Pink Premium Program. This is the Pink Gellac loyalty program which allows you to earn discounts on your order or save up for gifts. You can earn Pink Points in several ways, for example by buying from us online or in a brick-and-mortar shop, by redirecting new customers to us using your personalised link (“refer a friend”) or by following our social media channels. To this end, we will register your points balance and the action that earned you your points. We do this based on Pink Gellac’s legitimate interest, which is being able to offer our loyalty programme and interacting with our customers. If you do not wish to participate you can easily deregister by contacting our customer service.
2.4 Contact form and newsletter
There are several ways in which you can contact us. This can be done using the contact form or chat function on the website, by e-mail, WhatsApp or telephone. You will be asked to fill in various details so that we can handle your query. You decide which data you provide for this purpose. The personal data you provide are then processed for the handling of your query and/or complaint.
We publish a newsletter in which we inform interested parties about our products and/or services. Once you have subscribed to our newsletter, your e-mail address is automatically added to the list of subscribers. All newsletters include a link which allows you to unsubscribe.
2.5 Publication
When using our web shop, data may be published, which means that it will be visible to everyone on the Internet. After purchasing our products, we ask you to review our products and services. We do so on the basis of a legitimate interest, to help other people to make informed decisions and improve our products and services. You choose the information you wish to publish when you ask a question, review us or post a comment on a blog post. This might make you personally identifiable, for instance, if you include your first and last name. At your request, we will anonymise information that is published. You are always free to choose to remain completely anonymous.
2.6 Improving products, services and business operations and statistical analyses
For the purpose of providing quality, we may use your personal data, for example, if you complain about a product or our services. We also process personal data to gather statistical data. We do this for reasons of legitimate interest, i.e., to keep improving our products and services.
2.7 Promotion and marketing
When you buy a product from us, we may subsequently approach you regarding a similar product. We have a legitimate interest in doing so, namely, to offer you our products and keep you informed about them. If you do not wish to receive communications from us, you can unsubscribe. You can do this easily by clicking the "unsubscribe button" at the bottom of an e-mail.
In addition, we process your personal data by means of cookies, so we can show you personalised advertisements, for example. You can find more information on this topic in paragraph 4 below.
2.8 Miscellaneous
In some cases, we use your personal data for the purposes of combating fraud and/or abuse on grounds of a legitimate interest. We may also use your personal data if we need to defend ourselves against legal actions and other claims. Finally, we may process your personal data in the context of a merger or acquisition in so far as this is necessary to pursue a legitimate interest.

- if the services of third parties are used within the scope of agreements made with you (e.g. delivery services), Pink Gellac is entitled to disclose your personal data to the aforementioned third party to the extent necessary for the performance of the agreement to which you are, or the company you represent is, a party;
- if we suspect a violation of the rights of third parties, criminal offences or misuse, we may disclose personal data to third parties who have a legitimate interest in this respect or to bodies that serve the public interest. This may include enforcement authorities, such as the Public Prosecution Service or supervisory authorities;
- if we are required or entitled by law to provide personal data to third parties;
- we will provide details including your e-mail address and cookieID to our partners in order to show personalised advertisements;
- Pink Gellac also uses services provided by third-parties that act as "processors" (for example, hosting service providers and online marketing service providers). Pink Gellac is obliged to conclude a processing agreement with these service providers, which stipulates that they will only process personal data in accordance with Pink Gellac's instructions and subject to Pink Gellac's control. In this context, the necessary technical and organisational measures have been implemented to ensure that your data is processed reliably and securely.
In principle, your personal data will not be transmitted outside the European Economic Area. If, however, this does happen occasionally, Pink Gellac will take measures to ensure that the international transmission of personal data complies with applicable law.
4. Cookies
Our web shop uses cookies. When you visit our web shop for the first time, a message will be displayed explaining why we use cookies.
We use cookies that we place ourselves as well as cookies placed or read by third parties. Our website uses essential cookies which, among other things, ensure that the website works properly. These cookies are always active
Moreover, we use analytical cookies, as well as tracking and targeting cookies. We require your consent for these cookies.
4.1 Withdrawing consent
You can withdraw your consent at any time. You can do so by clicking “cookie preferences” at the bottom of the webpage and changing your settings. Moreover, you are at all times able to delete cookies that have already been placed from your computer, tablet or phone. 4.2 Personalised advertisements based on your interests
If you have consented to targeting cookies we, as well as third parties, will process your personal data in order to map your interests and show you personalised advertisements. By using cookies we collect various personal data, i.e. when you shop with us, when you create an account, when you subscribe to the newsletter and/or visit our web shop. On the basis of these personal data we determine your interests. Then we can send the relevant advertisement, your e-mail address and cookieID to partners, Google and Meta, to display targeted advertisements in line with your interests on these partners’ media channels.

5. Google Analytics
We use Google Analytics to track how visitors use our web shop. We have concluded a processing contract with Google to establish arrangements for the handling of our data. Furthermore, we have allowed Google to use the Analytics information gathered for other Google services.
6. Security
We take security measures to limit misuse of and unauthorised access to personal data.
7. Retention periods
The personal data described above will be retained for as long as necessary to process your orders, up to and including the warranty period. The personal data is then deleted, unless there is a legal obligation that requires longer retention. This could include the tax retention obligation of seven years.
If you have subscribed to the newsletter, we will retain your consent until such time as you unsubscribe.

This privacy statement does not apply to websites of third parties that are connected to our web shop through hyperlinks. We cannot guarantee that these third parties will handle your personal data in a responsible and secure manner.
