We respect your privacy and process your personal data in accordance with applicable laws and regulations. In this privacy statement, we inform you, among other things, how Pink Gellac processes your personal data, for what purposes and what rights you have. We recommend that you read it carefully.

Pink Gellac is the data controller for the processing of personal data through the online shop. We attach great importance to the careful handling of personal data. Personal data is therefore carefully processed and secured by us. When processing personal data, we comply with the requirements set by privacy legislation. This means, among other things:
  • we clearly state the purposes for which we process personal data. We do so via this privacy statement;
  • we limit our collection of personal data to only those necessary for legitimate purposes;
  • we first seek your explicit consent to process your personal data in cases where your consent is required;
  • we take appropriate security measures to protect your personal data and require the same from parties processing personal data on our behalf; and

2. Using our Webshop
When using our online shop, we obtain certain data from you. That could be personal information. We store and use personal data that is provided directly by you, in the context of the service you have requested, or which, when provided, it is clear that it will be provided to us for processing.
We usually process your personal data to enter into or perform an agreement with you, for example when you buy a product from us. Sometimes we process personal data to comply with a legal obligation, such as keeping our financial records. For certain processing, such as sending our newsletter, we ask for your consent. You can always withdraw this consent by contacting us via e-mail (see our contact details below). Finally, we may process your personal data on the basis of a legitimate interest.
We only process personal data that we collect directly from you. We do not obtain personal data from third parties.

2.1. Payment, handling and returning orders
When you place an order with us, we use your personal data for payment, processing and possible returns. We only do this to the extent necessary to fulfil the agreement with you. If necessary in this context, we may also provide your personal data to third parties. You can read more about this later in this privacy statement.

2.2. Personal account
You can create a personal account via our website. For this, we use your name, e-mail address and a password chosen by you. This account will make your shopping easier and faster and allows you to keep a wish list. You can also track your orders here. 

2.3. Contact form and newsletter
We offer several ways to contact us. This can be through a contact form, the chat function, email, whatsapp or by phone. You will be asked to fill in various details to handle your enquiry. You choose which data you provide in the process. The personal data you provide will then be processed to deal with your query and/or complaint.  We offer a newsletter through which we wish to inform interested parties about our products and/or services. After you have given your consent, your e-mail address is automatically added to the list of subscribers. Each newsletter contains a link allowing you to unsubscribe.

2.4. Publications
When using our online shop, data may be published so that it is visible on the internet for all to see. You choose what information you publish when asking a question or posting a comment on a blog post. It is possible that this may identify you, for example if you decide to leave your first and last name. Upon request, we will anonymise information that has been published. You are always able to remain completely anonymous.

2.5. Improving products, services and operations and statistical analysis
For quality purposes, we may use your personal data, for example if you complain about a product or our services. In addition, we process personal data to generate statistics. We do this on the basis of a legitimate interest, namely to keep improving our products and services.

2.6. Promotions and marketing
When you buy a product from us, we may approach you afterwards for a similar product. We have a legitimate interest in doing so, namely offering our products and keeping you informed about them. If you do not wish to receive communications from us, you can unsubscribe. This can easily be done by clicking the 'unsubscribe' button at the bottom of an email.

2.7. Other
In some cases, we use your personal data based on a legitimate interest to combat fraud and or abuse. We may also use your personal data if we need to defend ourselves against (legal) claims and demands. Finally, we may process your personal data in the context of a merger or acquisition insofar as this is necessary to pursue a legitimate interest. 

3. Disclosure to third parties
We may disclose your personal data to third parties in the following cases, for the reasons listed below: 
  • with suppliers to the extent necessary for the conclusion and performance of an agreement with you;
  • if third party services are used within the scope of arrangements with you (think delivery services), Pink Gellac is entitled to transfer your personal data to the aforementioned third party to the extent necessary for the performance of the agreement to which you are a party, or the company you represent is a party;
  • if we suspect a violation of third-party rights, criminal offences or abuse, we may disclose personal data to third parties who have a legitimate interest in doing so or to bodies serving the public interest. This may also include enforcement authorities, such as the public prosecutor or supervisory authorities;
  • aIf we are required or authorised by law to disclose personal data to third parties;
  • Pink Gellac also uses services from third parties who act as 'processors' (for example, hosting service providers and online marketing service providers). With these service providers, Pink Gellac is obliged to enter into a processing agreement which includes that they will only process personal data in accordance with the instructions and under the control of Pink Gellac. In doing so, appropriate technical and organisational measures are in place to ensure that your data is processed reliably and securely. 
In principle, your personal data will not be transferred outside the European Economic Area. However, should this incidentally happen, Pink Gellac will take measures to ensure that the international transfer of personal data complies with applicable law.  

4. Cookies
Our online shop uses cookies. When you visit our webshop for the first time, a message will be displayed explaining why we use cookies.  We use cookies that we set ourselves as well as cookies set or read by third parties. Our website uses functional cookies which, among other things, ensure that the website works properly. In addition, we use analytical cookies with a low privacy impact. We do not require your consent for these cookies. We also use tracking and targeting cookies. 5. Google Analytics
We use Google Analytics to track how visitors use our online shop. We have signed a processing agreement with Google to agree on how to handle our data. Furthermore, we have allowed Google to use the obtained Analytics information for other Google services.

6. Security
We take security measures to limit misuse of and unauthorised access to personal data.

7. Storage Periods
The personal data described above will be kept for as long as necessary to process your orders, including warranty. The personal data will then be deleted unless there is a legal obligation that requires longer retention. Consider the seven-year tax retention obligation.  If you have subscribed to the newsletter, we will keep that consent until you unsubscribe. 

8. Third-party websites
This privacy statement does not apply to third-party websites linked to our online shop. We cannot guarantee that these third parties will handle your personal data reliably or securely. We advise you to read the privacy statement of these websites before using them..

9. Adjustments in this privacy policy
We reserve the right to make changes to this privacy statement. It is recommended that you consult this privacy statement regularly so that you are aware of these changes.

10. Your rights and questions
For questions about our privacy policy or questions regarding the exercise of your rights, please contact us at any time using the details below. You can also send us a request to view, amend or delete your personal data. You can also make a request to request a data export for data that we use with your consent, or give a reasoned indication that you want us to restrict the processing of personal data. If you have given consent to us, you can withdraw that consent at any time. Moreover, you can object to the processing of personal data by us based on a legitimate interest. For marketing communications, you can always unsubscribe via a button at the bottom of an email.  To prevent abuse, we may ask you to identify yourself adequately when doing so. When it comes to accessing personal data linked to a cookie, you should send a copy of the cookie in question. You can find this in the settings of your browser. If the data is not correct, you can ask us to change it or have it deleted.
