Article 1 - Contract for use of social media posts #YesPinkGellac, #OuiPinkGellac, #GoPinkGellac, #AllezPinkGellac, #AgreePinkGellac, #AkkoordPinkGellac, #ApprouvePinkGellac, #AcceptPinkGellac, #AccepteerPinkGellac, and #AcceptePinkGellac

Pink Gellac would like to show off how you use your Pink Gellac products. For that reason, we may ask you on social media if we can use photos or other content posted by you about Pink Gellac (the 'Photo') on our advertising channels, such as our social media channels, our website (www.pinkgellac.com) or our newsletter.

By responding #YesPinkGellac, #OuiPinkGellac, #GoPinkGellac, #AllezPinkGellac, #AgreePinkGellac, #AkkoordPinkGellac, #ApprouvePinkGellac, #AcceptPinkGellac, #AccepteerPinkGellac, or #AcceptePinkGellac to a request from Pink Gellac to use your Photo, you declare that:

• You are the sole owner or copyright owner of the Photo #YesPinkGellac, #OuiPinkGellac, #GoPinkGellac, #AllezPinkGellac, #AgreePinkGellac, #AkkoordPinkGellac, #ApprouvePinkGellac, #AcceptPinkGellac, #AccepteerPinkGellac, or #AcceptePinkGellac you posted and that Pink Gellac will not violate any rights of third parties by using your Photo.
• You hereby grant Pink Gellac a non-exclusive, royalty-free, global and sublicensable licence to use your Photo for advertising purposes, including the right to reproduce, modify or edit the Photo. 
• To the extent permitted by law, you waive the right to attribution and other personality rights referred to in Article 25 of the Dutch Copyright Act. To the extent that such waiver is not permissible, you agree not to exercise these rights except with the consent of Pink Gellac.
• You have permission from the persons in this Photo to share it with Pink Gellac. If there are minors in this photo, you have permission from their parent(s) or guardian(s) to share this photo with Pink Gellac.
• If you are a minor, your parent(s) or guardian(s) have given permission to share this photo with Pink Gellac.
• You are not aware of any other objections to Pink Gellac's use of the Photo.

Pink Gellac may need to process your personal data, for example any personal data shown in the Photo. In that case, you can withdraw your consent to the processing of your personal data at any time by clicking on your own photo on our website at the bottom left on the circle with the ‘i’ in it and fill in the form that appears there. You can also send us an email with a direct link to the photo at info@pinkgellac.com. We will stop using your personal data from the moment you withdraw your consent. This will not affect any use of your personal data prior to the withdrawal of consent. For more information, see our privacy statement. 

These terms of use are governed by the laws of the Netherlands and the District Court of Amsterdam has jurisdiction to hear any ensuing disputes, unless another court has jurisdiction according to mandatory law.
